Affiliate Terms

Introduction

The Diyweb4u Affiliate Program allows approved Affiliates to earn commissions by referring paying customers to our website builder services, with no joining fees or hidden costs.
By applying to or participating in the Program, you agree to be bound by these Affiliate Terms.
If you do not agree, you may not participate.
We may update or modify these Terms at any time.
Continued participation constitutes acceptance of any changes.

This Affiliate Program operates within the Republic of South Africa.
We make no representation that this program is appropriate or available for use in other locations.

Eligibility and Application

• Affiliates must be at least 18 years old.
• Applications are subject to approval at our sole discretion.
• We reserve the right to accept or reject any application for any reason.
• Affiliates must provide accurate and complete information and keep it updated.

Affiliate Obligations

Affiliates agree to:

• Promote our services honestly and in good faith.
• Use only approved affiliate links and marketing materials.
• Comply with all applicable laws and regulations.
• Clearly disclose their affiliate relationship where applicable.

Prohibited Activities

Affiliates may not:

• Engage in spam, unsolicited communications, or misleading advertising.
• Use false claims or misrepresent our services.
• Perform self-referrals or create fake accounts.
• Engage in cookie stuffing or tracking manipulation.
• Bid on our brand name in paid advertising (unless approved).
• Promote via illegal, offensive, or inappropriate content.

We reserve the right to determine violations at our sole discretion.

Commission Structure

• Affiliates earn commission on qualifying payments made by referred customers.
• Commissions are calculated on the net amount (excluding VAT, discounts, refunds, or chargebacks).
• Commissions may be recurring for as long as the referred customer remains active.

Qualifying Referrals.

A referral qualifies when:

• A new customer signs up using your unique affiliate link.
• Payment is successfully completed.
• The transaction is not refunded or disputed.

Exclusions

No commissions will be paid on:

• Refunds or chargebacks
• Fraudulent or suspicious transactions
• Self-referrals
• Existing customers
• Free trials that do not convert to paid plans

We reserve the right to modify commission rates and structures at any time with notice.

Tracking and Attribution

• Referrals are tracked using cookies and/or tracking systems.
• Cookie duration is 90 days unless otherwise stated.
• Attribution is generally based on last-click unless specified otherwise.
• Our tracking system shall be the sole and final authority in determining referrals and commissions.

Payments and Payouts

Minimum payout threshold:

• Commissions shall only be paid once the Affiliate’s balance reaches a minimum of R250.
• Payments are made on the 1st of each month, provided that at least 31 days have passed since the qualifying transaction.
• Payments are made via EFT or other approved methods.

Currency:

• All payments are made in South African Rand (ZAR).
• Affiliates are solely responsible for any applicable taxes and VAT.

Long-Term Subscriptions:

• Where a referred customer purchases a subscription for more than one month, commission shall accrue progressively over the subscription term and shall be paid in arrears after each completed three-month period, provided the relevant subscription payments have been successfully received and are not subject to cancellation, refund, or chargeback.
• For subscriptions shorter than three months, commission shall become payable after the subscription period has been successfully completed.
• If the subscription is cancelled, refunded, or reversed before a scheduled commission payment becomes due, any unpaid commission relating to the affected period shall be forfeited.

Commission Reversal:

• Where a commission has already been paid to the Affiliate in respect of a subscription that is subsequently cancelled, refunded, reversed, or becomes the subject of a successful chargeback, DIYweb4U reserves the right to recover such commission by deducting it from any future commission payments due to the Affiliate.
• If no future commissions are payable, DIYweb4U may require the Affiliate to repay the amount within 14 days of written notice.

Intellectual Property

• Affiliates are granted a limited, non-exclusive, revocable license to use our approved marketing materials solely for the purpose of promoting our services in accordance with these Terms.
• Affiliates may not misuse or modify our branding without written permission.
  
• All intellectual property remains the sole property of Diyweb4u.

Customer Ownership

• All customers referred through the Program remain customers of Diyweb4u.
• Affiliates have no ownership rights over referred customers.

Term and Termination

• We may update, suspend, or discontinue the Affiliate Program at any time, with reasonable notice where possible.
• This agreement remains in effect until terminated.
• We may terminate or suspend your participation, including:
  • For violations of these Terms
  • For suspected fraud or abuse
  • Or for any other reason, where necessary to protect the integrity of the Program.
• Affiliates may terminate participation at any time.

Effect of Termination:

• Outstanding valid commissions may be paid
• No commissions will be earned after termination
• Fraudulent or invalid commissions may be withheld

Fraud, Abuse and Misuse

We reserve the right to:

• Investigate suspicious activity.
• Withhold or reverse commissions.
• Suspend or terminate accounts.
• All decisions regarding fraud or abuse are made at our sole discretion.

Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for indirect, incidental, or consequential damages.
• Our total liability shall not exceed the total commissions paid to you in the preceding 12 months

Relationship of Parties

Affiliates act as independent contractors.
Nothing in these Terms creates:

• A partnership.
• An employment relationship.
• An agency relationship.

Governing Law

• These Terms are governed by the laws of South Africa.
• Any disputes shall be subject to the jurisdiction of the courts of South Africa.

Amendments

• We reserve the right to modify these Terms at any time.
• Affiliates will be notified via email or dashboard updates where applicable.

Miscellaneous

• If any provision is found invalid, the remainder shall remain in effect.
• Failure to enforce any provision shall not constitute a waiver.
• These Terms constitute the entire agreement between the parties

Applicable Law

Nothing in these Affiliate Terms limits or excludes any rights, obligations, or remedies that cannot lawfully be limited or excluded under applicable law.
